Why is Salamanca Market By-Law being reviewed?

    The current Salamanca Market By-Law No.1 of 2010 is due for renewal. The renewed by-law will be valid for ten years. The Salamanca Market By-Law acts as a mechanism to manage and control conduct onsite on market days including buskers, stallholders, tour groups, waste disposal, noise and parking onsite.

    What are the key changes in the draft by-law?

    In preparing the draft Salamanca Market By-Law No. 2 of 2020, there has been a focus on eliminating duplication with other legislation and to ensure consistency with all existing City of Hobart by-laws.  

    A number of changes are recommended within the updated draft by-law, including; 

      • a contents page in the draft Salamanca Market By-Law No. 1 of 2022
      • removing clauses 3 and 4 from Salamanca Market By-Law No.1 of 2010 as the power is already available in existing legislation 
      • replacing specific buskers’ permit (clause 17) in Salamanca Market By-Law No.1 of 2010 with more generic permit clauses to allow for greater control over a broader range of activities
      • removing clauses 9, 10(2), 11, 12 from Salamanca Market By-Law No.1 of 2010 as they are already covered by the existing 2017-2022 Salamanca Market Licence Agreement
      • removing clauses 18, 19, 20, 25 and 26 from Salamanca Market By-Law No.1 of 2010 which are already covered by the existing Police Offences Act 1935, Vehicle and Traffic Act 1999 and Litter Act 2007
      • addition of clauses 64, 65, and 66 in the draft Salamanca Market By-Law No. 1 of 2022 for the removal and sale of vehicles
      • an increase in schedule penalty units from 0.5 point to 1 point for parking a vehicle within the designated market area between 5:30 am to 6 pm in the draft Salamanca Market By-Law No. 1 of 2022. The current penalty unit value is $173.00.

    Why do you have to collect my contact details to make my submission valid?

    As part of the engagement process for a review of a by-law we must collect your name and address. These details will be managed in accordance with the Council’s Privacy Policy, but please note that all submissions we receive will be presented to Council.

    Why have the penalty units for parking in the market area been increased?

    The Salamanca Market crew are required to move patron vehicles that have been left overnight in the market area. There is a cost associated with this and the increased penalty is a reflection of the effort involved.  There is clear signage in multiple areas to alert drivers of the need to remove vehicles prior to 5:30 am Saturday mornings.
