At its meeting on 11 July 2022, the Council delegated authority to the Chief Executive Officer to create the Salamanca Market By-Law No. 1 of 2022. The final version of Salamanca Market By-law can be found on the City of Hobart website.



Project Overview


The Salamanca Market By-Law No.1 of 2010 expired on 26 May 2020 and the City of Hobart is now preparing to renew the by-law under the provisions of the Local Government Act 1993. The Salamanca Market By-Law manages and controls conduct onsite on market days and covers areas including buskers, stallholders, tour groups, waste disposal, noise and parking.

This review provides the opportunity to update the by-law to reflect changing community expectations, changes in the City’s objectives, as well as changes in the external environment such as new legislation.

In preparing the draft Salamanca Market By-Law No.1 of 2022, there has been a focus on eliminating duplication with other legislation and to ensure consistency with all existing City of Hobart by-laws.

A number of changes are recommended within the updated draft by-law, relating to:

    • a contents page in the draft Salamanca Market By-Law No. 1 of 2022
    • removing clauses in the draft By-Law where the power is already available in existing legislation or already covered in the existing 2017-2022 Salamanca Market Licence Agreement
    • replacing specific buskers’ permit (clause 17) in Salamanca Market By-Law No.1 of 2010 with more generic permit clauses to allow for greater control over a broader range of activities
    • addition of clauses in the draft Salamanca Market By-Law No. 1 of 2022 for the removal and sale of vehicles
    • an increase in schedule penalty units from 0.5 point to 1 point for parking a vehicle within the designated market area between 5:30 am to 6 pm in the draft Salamanca Market By-Law No. 1 of 2022. The current penalty unit value is $173.00.

The new Salamanca Market By-Law No.1 of 2022 will have a life of 10 years.
